Welcome to Aging with Grace, a home healthcare service provider dedicated to delivering high-quality healthcare services to enhance the wellbeing and comfort of our clients. These comprehensive terms and conditions outline the expectations, responsibilities, and guidelines for the services offered by Aging with Grace. By availing our services, you acknowledge and agree to these terms. Please read them carefully before proceeding.

I. Services Provided

Aging with Grace offers a range of home healthcare services, including but not limited to trained caregivers, trained nurses, and registered nurses. Our team of healthcare professionals is carefully selected and trained to deliver exceptional care to individuals in the comfort of their homes. The specific services provided to each client will be determined based on individual needs and preferences.

II. Payment and Billing

a) All payments for services rendered by Aging with Grace shall be made directly to the company, and not to our staff. Our staffs are not authorized to discuss payment or receive payment on behalf of the company. Payments must be made in full, and we accept cash, bank transfers, and cheques.

b) The client agrees to be charged on an agreed-upon per day cost for the home healthcare services provided by Aging with Grace.

c) Aging with Grace shall provide the client with a detailed invoice for services rendered on a regular basis, as agreed upon between the client and the company. Payment shall be made in accordance with the agreed-upon payment schedule and method established by Aging with Grace.

d) In the event of any additional services requested by the client beyond the scope of the initial agreement, Aging with Grace shall provide the client with a revised estimate of costs before proceeding with the additional services.

e) Payments made to Aging with Grace are non-refundable, except in cases where services have not been provided as per the agreed-upon terms or as required by applicable law.

III. Staff Paid Leave

a) Aging with Grace provides its staff members with the opportunity to take up to two (2) days of paid leave per calendar month, subject to the company's leave policy and scheduling considerations.

b) The staff shall be required to submit leave requests at least 48 hours in advance, and approval will be granted based on the operational requirements and availability of replacement staff.

c) In the case of unforeseen emergencies or illness, staff members must promptly notify their supervisors or the HR department to request paid leave and provide appropriate documentation, such as a medical certificate.

d) The use of paid leave shall not adversely affect the quality or continuity of care provided to clients. Aging with Grace will make reasonable efforts to ensure appropriate staffing coverage during staff absences.

IV. Confidentiality and Privacy of Personal and Medical Information

Aging with Grace acknowledges the sensitive nature of the personal and medical information shared by our clients and their families. All information provided to us during the course of our services will be treated with the utmost confidentiality and privacy. As such, the following guidelines shall be strictly adhered to:

a) The Staff's Obligation: All staff members, including caregivers, nurses, and administrative personnel, are bound by strict confidentiality obligations. They shall not disclose any personal, medical, financial, or other sensitive information regarding clients or their families to any unauthorized individual or entity.

b) Access to Information: Personal and medical information shared by the client and their family members will be accessible only to authorized personnel on a need-to-know basis. This access shall be limited to facilitate the provision of home healthcare services and shall not extend beyond the scope of such services.

c) Handling of Records: Any physical or electronic records containing personal or medical information shall be securely stored and accessible only to authorized personnel. These records shall be subject to appropriate security measures to prevent unauthorized access, loss, theft, or disclosure.

d) Third-Party Disclosure: Aging with Grace shall not share or disclose any client information to third parties without obtaining explicit written consent from the client or their authorized representative, except as required by law or court order.

V. Privacy and Dignity of Clients

Aging with Grace places the privacy and dignity of our clients at the forefront of our services. We strive to create a compassionate and respectful environment where clients can comfortably receive care without intrusion. The following measures shall be taken to uphold the privacy and dignity of our clients:

a) Informed Consent: Aging with Grace shall obtain informed consent from the client or their authorized representative before initiating any home healthcare services. Clients shall be fully informed of the nature of the services, the personnel involved, and their rights regarding their information's confidentiality.

b) Communication Privacy: All discussions and communications between clients, their families, and staff members shall be conducted in private areas to ensure that sensitive information remains confidential.

c) Minimizing Intrusion: Our staff shall respect the personal space of clients and their families, minimizing any intrusion during the provision of services. This includes refraining from accessing private areas of the home or personal belongings without explicit permission.

d) Personal Belongings: Staff members shall not handle, inspect, or use clients' personal belongings without explicit permission, unless required to provide essential care or as part of their assigned duties.

VI. Scope of Services

a) Trained Caregivers: Our trained caregivers are skilled in assisting with Activities of Daily Living (ADL) to enhance the quality of life for our clients. These services include transferring and mobility assistance, grooming, bathing, toileting, incontinence care, dressing, maintaining a safe environment, communication support, feeding, administering prescribed oral medications, and vital signs monitoring.

b) Trained Nurses: Our trained nurses, with their Nursing Diploma, possess expertise in various healthcare procedures, including monitoring vitals, Continuous Blood Glucose (CBG) monitoring, diabetes care (administering insulin), postoperative care, basic wound care, catheter care, spirometry, chest physiotherapy, and administering prescribed medications, including over-the-counter and non-intravenous medications. Additionally, they provide assistance with ADLs.

c) Registered Nurses (RN): Our Registered Nurses bring extensive nursing experience and specialized qualifications to our services. They are equipped to handle critical situations, intravenous care (removal and insertion), Ryle's tube care, catheter care, ventilator care, and tracheostomy care. They also offer assistance with ADLs and are trained in recognizing early warning signs.

VII. Staff Shifts and Rest Periods

Our staff operates on either 12-hour or 24-hour shifts, ensuring continuous support and assistance for our clients. A 12-hour shift spans 12 consecutive hours, while a 24-hour shift provides continuous care throughout the day and night. We recognize the importance of rest for our staff's physical and mental well-being, and they are entitled to sufficient rest periods after each shift.

a) 12-Hour Shifts: A 12-hour shift will commence at the designated start time, for example, 7:00 AM, and conclude after 12 consecutive hours, at 7:00 PM on the same day. Similarly, the night shift will commence at 7:00 PM and conclude at 7:00 AM the next day, ensuring round-the-clock care for our clients.

b) After completing a 12-hour shift, staff members are entitled to an uninterrupted rest period of at least 8 hours before the commencement of their next shift, ensuring their well-being and ability to provide compassionate and attentive care.

c) 24-Hour Shifts: In certain situations, Aging with Grace may require staff members to work 24-hour shifts, providing continuous care and support to our clients. A 24-hour shift will commence from the agreed-upon service start time and will span a full 24-hour period, concluding at the same start time on the following day.

d) During a 24-hour shift, our dedicated staff will remain present at the client's place of care, which may include the client's private residence, a hospital ward, a nursing home, an assisted living facility, or any other location where home healthcare services are required. This arrangement ensures round-the-clock monitoring and assistance. This allows us to respond promptly to any emergent needs or provide continuous care for clients who require continuous medical attention.

e) Meals and light refreshments for staff: Aging with Grace acknowledges the importance of providing our staff with the necessary sustenance during 24-hour shifts. Therefore, clients are kindly requested to arrange and provide three meals for the staff. The three meals should include breakfast, lunch, and dinner, as well as light refreshments and beverages to maintain their energy levels. The cost of providing the three meals and light refreshments for staff during 24-hour shifts shall be borne by the client as an additional charge to the agreed-upon per day cost for home healthcare services. Aging with Grace shall provide clients with the necessary details and breakdown of these additional charges upon request.

f) Rest Period After 24-Hour Shift: After a 24-hour shift, staff members shall be entitled to a rest period of at least 4 hours and total of minimum 6 hours in total, during which they are permitted to leave the client's residence, except in exceptional circumstances or emergencies that require their immediate attention. Aging with Grace shall coordinate with clients and staff to ensure adequate rest periods and compliance with relevant labor laws and regulations.

VIII. Safe and Comfortable Rest Area

Aging with Grace emphasizes the importance of providing staff with a safe and comfortable place to sleep and rest during their shifts, especially for 24-hour shifts. Clients are required to provide staff members with access to a designated rest area that includes:

a) Safe Environment: The rest area shall be in a secure and private location within the client's residence, ensuring the safety and privacy of the staff during their rest periods.

b) Comfortable Sleeping Arrangements: Clients shall provide appropriate bedding, such as a bed or a comfortable sleeping arrangement, along with fresh pillowcases and sheets.

c) Adequate Amenities: The rest area should be equipped with basic amenities to facilitate the staff's comfort, such as access to bathroom and laundry facilities.

d) Staff's Personal Belongings: Staff members shall be responsible for bringing their own set of clothes and toiletries for personal use during their shifts. The provision of a designated storage area for staff belongings, such as a wardrobe or lockable storage space, is appreciated to ensure the organization and security of personal items.

e) Client Cooperation: Aging with Grace seeks the cooperation of clients in ensuring that the staff's rest periods are respected and protected. Clients shall work collaboratively with the staff to coordinate any necessary care requirements, ensuring that the client's needs and health are adequately addressed without interrupting the staff's rest time.

IX. Professional Conduct

At Aging with Grace, we maintain the highest standards of professional conduct among our staff members. Our caregivers and nurses are committed to providing compassionate care, treating clients and their families with respect, courtesy, and dignity. Our staff members maintain personal hygiene and dress professionally in accordance with our dress code policy.

X. Medical Advice

Aging with Grace's staff members are not authorized to provide medical advice, diagnose medical conditions, or prescribe medications. Clients are responsible for seeking professional medical advice from licensed healthcare providers for any medical concerns.

XI. Non-Disclosure

Our caregivers and nurses shall not exchange personal or confidential information with clients without explicit authorization from Aging with Grace. This includes refraining from sharing personal contact information, social media accounts, or any other form of personal identification.

XII. Non-Solicitation

Our staff members shall not solicit business or request contact details from clients or their families for personal or professional gain. Any client inquiries or requests for services shall be directed to Aging with Grace.

XIII. Liability

a) Aging with Grace is committed to providing high-quality and safe healthcare services. However, we shall not be held liable for any damages, injuries, or losses resulting from events or circumstances beyond our reasonable control or outside the scope of our agreed-upon services.

b) Our staff members shall not hold Aging with Grace responsible or liable for any personal injuries, accidents, or damages incurred during the course of their employment.

XIV. Termination of Services

Aging with Grace reserves the right to terminate services to a client if there is a violation of these terms and conditions or if we deem it necessary to protect the safety and wellbeing of our staff and clients. Clients may also terminate services with Aging with Grace by providing a written notice 48 hours prior to termination of services via email to info@agingwithgrace.in.

XV. Amendment of Terms and Conditions

Aging with Grace reserves the right to amend or modify these terms and conditions at any time. Any changes will be communicated to clients through appropriate channels, and continued use of our services after the amendments shall constitute acceptance of the revised terms.

XVI. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of India Any dispute arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Chennai.
